Terms & Conditions

These Terms govern your use of CrossExamine, a study and apologetics application, and of the website at agape-labs.co.za (together, the “Service”).

1. Who you are contracting with

The Service is provided by Shamah Muteme, a sole proprietor trading as Agape Labs, established in the Republic of South Africa (“we”, “us”, “our”).

2. Accepting these Terms

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and to the Privacy Policy and Refund Policy, which form part of them. If you do not agree, do not use the Service.

3. What the Service is

CrossExamine helps you study Christian belief and the worldviews it encounters. It searches an index of publicly published apologetics recordings, together with public-domain Bible translations and Greek and Hebrew lexicons, and presents what it finds with attribution to the source.

The Service includes, depending on your plan and chosen mode:

  • question answering with cited source passages;
  • practice conversations against worldview personas, with a written debrief;
  • claim checking and argument construction tools;
  • a Bible reader, multi-translation comparison and lexicon lookup;
  • personal study tools — notes, saved objections, spaced review, verse tags;
  • optional small-group study circles.

Features vary by mode (Seeker, Explorer, Defender) and allowances vary by plan. These are independent: any plan may use any mode.

4. Who may use it

You must be at least 16 years old to create an account. If you are under 18, you must have permission from a parent or legal guardian. You must also have the legal capacity to enter into a contract, and you must not be barred from using the Service under the laws applicable to you.

5. Your account

  • You are responsible for keeping your login credentials secure and for everything done through your account.
  • Accounts are personal. Do not share, sell or transfer your account.
  • Give us accurate information and keep it current.
  • Tell us promptly at support@agape-labs.co.za if you believe your account has been accessed without your permission.

6. Plans, billing and renewal

Current plans and prices are published at agape-labs.co.za/pricing. Prices are stated in US dollars. Any sales tax, VAT or equivalent due in your country is calculated at checkout and shown to you before you pay.

  • Renewal. Paid plans renew automatically at the end of each billing period at the then-current price for your plan, until cancelled.
  • Trials. Defender Max opens with a 5-day free trial. A payment method is required to start it, and nothing is charged during it. The trial runs at Defender daily allowances rather than Defender Max ones. If you do not cancel before the trial ends, the plan begins and the first payment is taken. One trial per person.
  • Plan changes. Upgrades and downgrades both take effect at your next renewal, at the new price. We do not prorate mid-period in either direction. This is deliberate: it means no partial charges and no partial credits to reconcile.
  • Price changes. We may change prices. We will give you at least 30 days’ notice by email before a change affects your renewal, and you may cancel before then. A change never applies to a period you have already paid for.
  • Failed payments. If a payment fails we may retry it and may suspend paid features until it succeeds. Your content is not deleted while a payment is outstanding.

7. Who processes your payment

Our order process is conducted by our online reseller Paddle.com Market Ltd. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries relating to billing and handles returns for those orders.

This means Paddle, not we, is the seller of record for your purchase, and Paddle’s own terms apply to the payment transaction alongside these Terms. We never receive or store your card number. Payment card details are handled entirely by Paddle and its payment processors.

8. Cancelling and refunds

You may cancel at any time from your account settings. Cancellation stops the next renewal; you keep your paid features until the end of the period you have already paid for, after which the account moves to the Free plan. Your notes, saved objections and other content are not deleted when a subscription ends.

Refunds are governed by our Refund Policy, which forms part of these Terms and sets out rights that are in addition to, and do not replace, any refund or cooling-off rights you have under the law of your own country.

9. Usage allowances and fair use

Features that call an artificial-intelligence model carry a published daily allowance, listed in full on the pricing page. We publish these numbers rather than describing any such feature as “unlimited”.

Features that do not call a model — reading, searching, comparing translations, lexicon lookup, reviewing your own saved material — are not metered.

We may apply reasonable technical limits to protect the Service from automated or abusive use, including rate limits. We may vary published allowances on 30 days’ notice by email; we will not reduce them during a period you have already paid for.

10. Acceptable use

You agree not to:

  • use the Service to harass, threaten, defame or incite violence or hatred against any person or group, including on grounds of religion, belief or the absence of belief;
  • upload or submit unlawful content, or content you have no right to submit;
  • attempt to gain unauthorised access to the Service, other accounts, or any system connected to it;
  • scrape, bulk-download, resell or redistribute the source index, transcripts, or any substantial part of the Service’s content;
  • use automated means to place requests, other than through an interface we provide for that purpose;
  • reverse engineer or attempt to extract the underlying models, prompts or source data, except to the extent that restriction is prohibited by law;
  • use output from the Service to misrepresent what a named person said or believes;
  • resell, sublicense or provide the Service to third parties as your own.

Study circles are shared spaces. Content you post into a circle is visible to its other members, and the acceptable-use rules above apply there in full.

11. Your content

Your notes, questions, saved objections, verse tags, letters and anything else you write remain yours. You grant us a limited, non-exclusive licence to store, process and display that content solely in order to operate the Service for you — for example, to save a note and show it back to you, or to send a question to our AI provider so it can be answered.

That licence is limited to running the Service. We do not use your content to train AI models, we do not sell it, and we do not publish it. It ends when you delete the content or your account, except for backups which age out on the schedule set out in the Privacy Policy.

Content you deliberately post into a shared space, such as a study circle or a public prayer board, is visible to the people that space is shared with. Do not post anything there you would not want those people to read.

12. Our content, and other people’s

The Service, its software, design, text and arrangement are owned by us or our licensors and are protected by copyright and other laws. These Terms grant you a personal, non-transferable, non-exclusive right to use the Service for your own study, and nothing more.

Third-party material. The Service quotes and links to recordings published by their authors on public platforms. Those excerpts are presented as quotations, attributed to the channel that published them, and linked back to the original recording at the point quoted. Copyright in that material remains with its authors. The Service does not generate new statements in a named person’s voice or style.

Removal requests. If you are the rights holder in material that appears in the Service and you want it removed, write to support@agape-labs.co.za. We act on such requests promptly and without argument, and removal deletes both the stored transcripts and everything derived from them.

Biblical texts and lexicons. The Service uses public-domain and openly licensed texts. Their provenance and licence terms are recorded in the application.

13. AI-assisted output, and its limits

Parts of the Service use large language models to read retrieved source passages and express them in readable prose. You must understand the following, and it is a condition of using the Service that you do:

  • Output may be wrong. AI-generated prose can be inaccurate, incomplete or misleading, even when the underlying sources are sound.
  • Citations are computed, not written by the model. Where the Service shows a source, a channel or a timestamp, that comes from the search index rather than from generated text. This is a deliberate design choice intended to prevent invented references, but it is not a guarantee of correctness.
  • Silence is a real answer. Where the index holds nothing relevant, the Service is designed to say so rather than produce an unsupported answer. An empty result is not a fault.
  • Quoted views are not our views. Material retrieved from third-party recordings represents the speaker’s position, not ours, and its presence in the Service is not an endorsement.
  • Practice personas are simulations. A persona representing a worldview is a training exercise built from source material. It does not speak for any real person, organisation or religious community.
  • Verify before you rely. Check the cited source before you use anything from the Service in a real conversation, in writing, or in any context where being wrong matters.

14. Religious content, and what this Service is not

The Service presents religious, theological and philosophical material, including views that contradict one another and views you may find objectionable. Presenting a position is not endorsing it.

The Service is a study tool. It is not pastoral counselling, spiritual direction, mental-health care, legal advice or professional advice of any kind, and it is not a substitute for any of them. If you are in distress, please speak to a qualified person or an emergency service in your country.

15. Availability and changes

We aim to keep the Service available but do not promise uninterrupted access. It may be unavailable for maintenance, upgrades, or reasons outside our control.

We may add, change or remove features. If we materially reduce a feature that is central to a paid plan, or discontinue the Service altogether, we will give you at least 30 days’ notice by email and refund the unused portion of any period you have paid for.

16. Suspension and termination

You may stop using the Service and delete your account at any time from your account settings.

We may suspend or terminate your account if you materially breach these Terms, if we are required to by law, or to protect the Service or its other users. Other than where the breach is serious or where the law prevents it, we will tell you first and give you a reasonable opportunity to put it right. Where we terminate an account for a reason that is not your breach, we refund the unused portion of the current period.

On termination your right to use the Service ends. Deletion of your data follows the Privacy Policy.

17. Disclaimers

To the fullest extent permitted by law, and except as expressly stated in these Terms, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Nothing in these Terms excludes or limits any right you have that cannot lawfully be excluded or limited — including your rights under the South African Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002, and any equivalent consumer protection law that applies where you live.

18. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, nor for loss of profit, revenue, goodwill or data, arising out of your use of the Service.

Our total aggregate liability to you for all claims arising in any 12-month period is limited to the greater of (a) the amount you paid us for the Service in that period, and (b) USD 50.

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

19. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, from content you submit, or from your unlawful use of the Service. This does not apply where the claim arises from our own breach or negligence.

20. Governing law and disputes

These Terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection rules of your country of residence, nor of the right to bring proceedings in your local courts where the law gives you that right.

Please write to us first at support@agape-labs.co.za. Most problems are quicker to fix than to litigate.

21. Changes to these Terms

We may update these Terms. For material changes affecting a paid subscriber we will give at least 30 days’ notice by email before they take effect, and you may cancel before then. The effective date and version at the top of this page always reflect the current text.

22. General

  • If any provision is held unenforceable, the rest remains in force.
  • Our not enforcing a provision does not waive it.
  • You may not transfer your rights under these Terms. We may transfer ours to a successor of the business, on notice to you, provided your rights are not reduced.
  • These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between us about the Service.
